Terms of Use
1. General
These Terms of Use govern your use of the Shelity app and related services, and you agree to them by creating an account or using the app.
Effective date: [app publication date]
Who we are. The app is provided by Oleksii Bilousov, mkr. 3, building 17, Lozova, 64600, Ukraine, email: privacy@shelity.com. Referred to below as “we”.
What Shelity is. An Android and iOS app for tracking household items and supplies in a shared “Home” space. It works offline and syncs data with the server when a connection is available.
Related documents. Processing of personal data is described in the Privacy Policy (Privacy Notice). It forms part of these Terms.
Age. Shelity may be used by people aged 16 and over. If you are younger, do not create an account.
If you disagree with the Terms, do not use the app and delete your account.
2. Account and security
You need an account to use the app, and you are responsible for everything that happens under it.
Sign-in methods. You can create an account with Google, with Apple on iOS, or with email and password.
Your obligations:
- provide accurate data and keep it up to date;
- do not share your password or account access with others;
- notify us immediately at privacy@shelity.com if you suspect unauthorized access;
- have only one account unless we separately allow otherwise.
We may ask you to confirm your email or identity to protect the account.
Responsibility for actions. Actions taken from your account are treated as yours, unless you prove that access was obtained without your fault.
3. Spaces and members
Data in Shelity is stored in spaces, and every member of a space sees its records.
The “Home” space. A shared space for tracking items and supplies, for example for a family or housemates. One account can have several spaces if your plan allows it.
Owner. The space owner creates the space and manages its members: adds and removes them. A space can have up to 5 members, including the owner.
How to add a member. The owner creates a temporary QR code (for people nearby) or a temporary code entered manually. The code is valid for a limited time and grants access to the space, so share it only with people you trust.
Member rights. All members have equal rights over the space’s records: add, change and delete them; only the owner manages members, the subscription and deletion of the space. Everything you add to a space is visible to all its members.
Your responsibility.
- You decide whom to add to a space and are responsible for it.
- We do not verify relationships between members and do not resolve their disputes about records or property.
- Any member can leave a space, and the owner can remove a member. Records they added remain in the space.
Deleting a space. If the owner deletes their account, their space is deleted and all members lose access to it (see section 7).
4. Plans, subscription and payment
Shelity has a free plan with ads and two paid subscriptions; payment and refunds are handled by Google Play and the Apple App Store.
Plans:
| Feature | Free | Premium | Premium+ |
|---|---|---|---|
| Members per space | up to 2 | up to 5 | up to 5 |
| Spaces | 1 | up to 5 | unlimited |
| Images in the cloud | no (device only) | yes, with a quota | yes, unlimited (fair use) |
| Records in the cloud | up to 25 | up to 200 | unlimited |
| Records on the device | unlimited | unlimited | unlimited |
| Expiry and stock notifications | basic | yes | yes |
| Data export | no | yes | yes |
| Statistics and analytics | no | basic | advanced |
| Ads | yes | no | no |
The detailed feature list and current prices are shown in the app and in the store before purchase. We may change the plan contents with advance notice (see section 9).
Ads. The free plan shows ads. Personalized ads are shown only with your consent (see the Privacy Policy).
Free trial. A new paid subscription may start with a 7-day free trial. If you do not cancel before the trial ends, you will be charged for the first period.
Terms and renewal. Subscriptions are available monthly or yearly. They renew automatically for the same term at the price then in effect until you cancel.
Payment. Payment is taken by Google Play (including via Google Pay) and the Apple App Store (including via Apple Pay). We do not see or store your card details. Price, taxes and currency are shown in the store.
Cancellation. You can manage and cancel your subscription in Google Play or Apple ID settings. Deleting the app or your Shelity account does not cancel the subscription automatically, so cancel it separately. After cancellation, paid features remain available until the end of the paid period.
Refunds. We do not take payments directly, so refunds are handled only by Google Play and the Apple App Store under their own rules. Contact the relevant store. This does not limit your rights guaranteed by law.
Who pays. The space owner purchases the subscription and it applies to the whole space. Other members purchase nothing.
Limits. Our server checks the limits. The app shows how much of a limit is used and warns before it is reached. Records on your device are not limited. On the free plan, images are stored only on the device and are not synced, so other members do not see them. If you lose your device, records and images that are not in the cloud may be lost.
“Unlimited” (Premium+). This means fair use: to protect the service we may set technical limits on the size of a single image and total storage (currently a single image may be up to 3 MB); current limits are shown in the app.
After a subscription ends. You return to the free plan and we do not delete your data because the subscription ended. Free-plan limits apply again: anything above those limits (for example a third member, a second space or images in the cloud) becomes view-only. You do not lose data, but you cannot add or change it beyond the limit until you upgrade.
5. Rules of use
Use Shelity lawfully and in a way that does not harm the service or other people.
Permitted: using the app for personal tracking of items and supplies in your home.
Prohibited:
- violating laws or the rights of others;
- uploading or entering unlawful, harmful or offensive content, or other people’s personal data without the right to do so;
- trying to access other people’s accounts, spaces or data, or bypassing plan limits and service protection;
- interfering with the server: overloading it, scanning for vulnerabilities without our permission, using automated scripts and bots;
- decompiling, modifying or copying the app, except where the law allows;
- reselling access, providing it to others for payment, or using Shelity commercially;
- artificially inflating or reducing ad impressions, or clicking ads without intending to use the offer;
- impersonating another person.
Consequences. If you violate these rules, we may warn you, temporarily restrict or block your account (see section 7).
6. Your data and intellectual property
Your records remain yours, and the app and its name belong to us.
Your records. Item names, categories, rooms, notes, photos and other data you enter belong to you (or the members of your space). You retain all rights to them.
What we may do with them. You grant us a limited, non-exclusive license to store this data, deliver it to your devices and space members, create backups and process it only as needed to operate the service. We do not sell your data and do not use it to train artificial intelligence models. Other details are in the Privacy Policy.
Your warranty. You confirm you have the right to enter this data (including photos and other people’s personal data, if you enter them).
Ours. The app, its code, design, logo and the name “Shelity” belong to us or our licensors. We grant you a personal, non-exclusive, non-transferable license to install and use the app for personal purposes on your devices while these Terms apply. Rights not expressly granted remain with us.
Feedback. If you offer us ideas or feedback, we may use them freely without obligation to you.
Third-party services. The app uses services of Google, Apple and other companies (sign-in, payment, ads, analytics). Their own terms apply to them.
7. Account deletion and termination of access
You can delete your account at any time, and we may restrict access if you violate the Terms.
Logging out. Logging out does not delete data or spaces: they stay in place.
Account deletion.
- You start deletion in the app settings or submit a request on the account deletion page.
- We warn you about the consequences.
- For 7 days you can cancel the deletion.
- After 7 days we delete all data linked to your account.
Space owner. If you own a space, deleting it together with your account deletes the space itself: all members lose access to it. Warn them in advance.
Subscription. Deleting your account does not cancel the subscription: cancel it in Google Play or Apple ID so you are no longer charged (see section 4).
Our rights. We may warn you, temporarily restrict or block your account if you violate the Terms or the law, abuse the service or harm others. Where possible we will state the reason, and you may contact privacy@shelity.com. In case of serious violations we may act without notice.
Ending the service. We may change or discontinue Shelity or individual features. We will give advance notice of discontinuation, at least 30 days, and allow you to save your data via export in the app or on request at privacy@shelity.com.
What survives termination. The sections on intellectual property, limitation of liability, governing law and disputes continue to apply.
8. Warranties and limitation of liability
We aim for Shelity to work reliably but cannot guarantee uninterrupted operation, and our liability is limited to the extent permitted by law.
As is. The app is provided “as is” and “as available”. We do not guarantee it will always work without failures, errors or interruptions (including due to maintenance or failures of the internet or third parties).
Tracking is not professional advice. Shelity helps you keep personal records but does not replace accounting, tax or insurance records. You verify the accuracy of records yourself.
Offline mode and sync. Records entered offline are stored on the device and synced later. If you change the same data on different devices, or delete the app or clear its data before syncing, changes may be lost or merged with conflicts. For important data use export: on paid plans it is available in the app (CSV/Excel), and on the free plan you can request a copy of your data at privacy@shelity.com.
Other members’ actions. We are not responsible for records added, changed or deleted by other members of your space.
Third-party services. We are not responsible for the operation of Google, Apple, advertising, payment and other third-party services or for ad content.
Limitation. To the extent permitted by law, we are not liable for indirect damages, lost profit or loss of data arising from use of or inability to use Shelity. Our total liability to you is limited to the amount you paid us for the subscription in the last 12 months, and for the free plan to 0 (to the extent permitted by law).
What is not limited. These limits do not apply to liability that the law does not allow to be limited, including for intentional breach or harm to life and health, and do not change your statutory consumer rights.
9. Changes, governing law and contacts
We may update these Terms, Ukrainian law applies to them, and you can send us questions by email.
Changes to the Terms. We will notify you of material changes in the app or by email at least 7 days before they take effect. If you continue using Shelity after that date, you are deemed to have accepted the new Terms. If you disagree, stop using the app and delete your account. Changes to prices and plans do not affect an already paid subscription period.
Governing law. These Terms are governed by the law of Ukraine. This does not deprive you of the protection of mandatory rules of the law of the country where you live, including consumer law.
Disputes. First write to us at privacy@shelity.com and we will try to resolve the matter amicably. If that fails, the dispute is heard by a court under the jurisdiction rules set by law. Consumers may bring a claim in the court of their place of residence where the law gives that right.
Severability. If a court finds a provision of the Terms invalid, the rest remain in force. Our not exercising a right immediately does not waive it. You may not assign your rights under these Terms to others without our consent, and we may assign ours to a successor.
Apple and Google. Apple and Google are not parties to these Terms and are not responsible for the app, its support or claims about it. They may enforce the Terms against you as a third-party beneficiary where their rules provide.
